Terms of Service

1. Acceptance of Terms

By accessing or using the Sports Data Now LLC platform at app.sportsdatanow.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you ("User") and Sports Data Now LLC ("Company," "we," "us," or "our").

2. Description of Service

Sports Data Now LLC provides a sports data analytics platform that aggregates, displays, tracks, and analyzes sports statistics, scores, bet records, grading outcomes, and related data for informational and entertainment purposes. The Service may include dashboards, data visualizations, historical records, third-party data feeds, and integrations with third-party messaging platforms such as Discord, Telegram, or similar services to facilitate data collection from users.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

4.1 Registration

Some features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at info@sportsdatanow.com.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

5. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Scrape, crawl, or systematically extract data from the Service without our express written permission
• Reproduce, distribute, modify, create derivative works of, or commercially exploit any content from the Service without authorization
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Transmit any viruses, malware, or other harmful code through the Service
• Use the Service in any manner that could disable, overburden, or impair the Service's infrastructure
• Use automated tools or bots to access the Service without prior written consent
• Submit false, misleading, or fraudulent bet data or other information to the Service

6. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, data compilations, grading logic, analytics, and software, are the exclusive property of Sports Data Now LLC or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

7. Third-Party Platforms and Integrations

7.1 Third-Party Platform Access

The Service may integrate with or access third-party messaging and communication platforms, including but not limited to X, Discord, Telegram, SMS, email, and similar services ("Third-Party Platforms"), for the purpose of collecting bet data, picks, or related information that users submit or post on such platforms. By using the Service, you authorize Sports Data Now LLC to access and collect data you provide through any connected Third-Party Platform in accordance with these Terms and our Privacy Policy.

7.2 Third-Party Platform Terms

Your use of any Third-Party Platform is subject to that platform's own terms of service, privacy policy, and community guidelines. We are not responsible for the availability, content, or practices of any Third-Party Platform. We do not control and are not liable for any data loss, privacy breach, or other harm arising from your use of Third-Party Platforms.

7.3 Connecting Your Sources

You may connect only the channels, accounts, phone numbers, email addresses, and other sources ("Sources") that you own or are authorized to control. Whether you connect a Source yourself or ask us to set it up for you, before it starts collecting data we verify that you own or control it, using a method suited to the platform, such as signing in with the platform, adding our bot to your server or channel, or confirming a one-time code (by email, or by texting it from your phone). Where a Source works through our bot (for example, on Discord or Telegram), the bot stays in your server, channel, or group for as long as the Source is connected, and removing the bot stops collection from that Source. We may decline, pause, disable, remove, or reassign any Source that fails verification, appears to belong to someone else, is the subject of an ownership dispute, or is used in violation of these Terms.

7.4 Third-Party Data Sources

The Service may also incorporate sports data, statistics, and content sourced from third-party data providers. We make no representations or warranties regarding the accuracy, completeness, or timeliness of third-party data. We are not responsible for the content, reliability, or practices of any third-party data sources integrated within the Service.

8. Data Accuracy and User Responsibility

8.1 No Warranty of Accuracy

ALL DATA DISPLAYED ON THE SERVICE, INCLUDING BUT NOT LIMITED TO BET RECORDS, GRADING OUTCOMES, STATISTICS, SCORES, ODDS, AND ANALYTICS, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. SPORTS DATA NOW LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY DATA ON THE SERVICE.

8.2 User-Submitted Data

Much of the data tracked and displayed through the Service is entered or submitted by users themselves. We do not independently verify, audit, or guarantee the accuracy of any user-submitted data, including bet picks, wager amounts, odds, or outcomes. Users are solely responsible for the accuracy of the data they submit.

8.3 Grading Disclaimer

Bet grading provided through the Service is based on available data and automated or manual processes and may contain errors. Sports Data Now LLC expressly disclaims any liability for grading errors, incorrect outcomes, or data discrepancies. Graded results are provided for informational and record-keeping purposes only and should not be relied upon as authoritative or final.

8.4 No Liability for Data Reliance

SPORTS DATA NOW LLC SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, OR CLAIMS ARISING FROM A USER'S RELIANCE ON ANY DATA, GRADING, STATISTICS, OR ANALYTICS PROVIDED BY THE SERVICE. USERS ASSUME ALL RISK ASSOCIATED WITH USE OF OR RELIANCE ON SERVICE DATA.

9. User Data: Sharing and Downstream Use

9.1 User Responsibility for Data Sharing

Sports Data Now LLC is not responsible for how users choose to share, distribute, publish, or use data or reports generated by or exported from the Service. Any decision to share bet records, performance data, analytics, or any other Service-generated content with third parties, including on social media, messaging platforms, websites, or in any commercial context, is made solely at the user's own risk and discretion.

9.2 No Liability for Downstream Use

SPORTS DATA NOW LLC EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM, LOSS, LEGAL CLAIM, OR REPUTATIONAL DAMAGE ARISING FROM A USER'S SHARING, PUBLISHING, OR COMMERCIALIZATION OF DATA DERIVED FROM THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO: LOSSES RESULTING FROM THIRD PARTIES ACTING ON SHARED PICKS OR PERFORMANCE DATA; VIOLATIONS OF APPLICABLE LAWS BY USERS WHO COMMERCIALLY DISTRIBUTE SERVICE DATA; AND ANY DISPUTES BETWEEN USERS AND THIRD PARTIES RELATED TO SHARED CONTENT.

9.3 Prohibited Commercial Distribution

You may not sell, license, or commercially distribute data, reports, or analytics generated from the Service without the express prior written consent of the Company. Any such use without authorization is a violation of these Terms and may result in immediate account termination.

10. Sports Betting: Tracking Only Disclaimer

Sports Data Now LLC provides tools that allow users to log, track, and analyze their own sports wagers for personal record-keeping and informational purposes only. The Service is strictly a data tracking and analytics platform.

By using any betting-related features of the Service, you acknowledge and agree to the following:

• Sports Data Now LLC is NOT a sportsbook, gambling operator, betting exchange, or any form of licensed gaming entity.
• The Service does NOT facilitate, process, accept, or place any sports wagers or bets on your behalf. No money is wagered, held, or exchanged through the Service.
• All betting data entered into the Service is self-reported by the user and used solely for personal tracking and statistical analysis.
• You are solely responsible for ensuring that your participation in sports wagering complies with all applicable federal, state, and local laws and regulations in your jurisdiction.
• The Service does not provide gambling advice, betting tips, or recommendations intended to influence wagering decisions.
• Users located in jurisdictions where sports betting is prohibited or restricted are responsible for understanding and complying with local laws. Use of the Service's tracking features does not constitute authorization or encouragement to engage in any betting activity.

Sports Data Now LLC expressly disclaims any liability arising from a user's participation in sports wagering or gambling activity of any kind. If you or someone you know has a gambling problem, help is available 24/7 through the National Problem Gambling Helpline at 1-800-522-4700 or ncpgambling.org .

11. Plans, Payments and Refund Policy

11.1 Payment Processing

The Service may offer paid subscription plans or one-time purchases. All payments are processed securely through Stripe, a third-party payment processor. By providing your payment information, you authorize Sports Data Now LLC to charge the applicable fees to your payment method via Stripe. Sports Data Now LLC does not store your full credit card or banking details. All payment data is handled directly by Stripe in accordance with their Privacy Policy and PCI-DSS compliance standards.

11.2 Subscription Plans and Message Quotas

Paid plans are billed monthly and include a monthly quota of messages, as shown on our Pricing page or at checkout when you subscribe or change plans. Your quota resets at the start of each billing period. Unused messages, including unused overage messages, do not roll over and expire at the end of the billing period. Custom plans have the quota and price we agree with you in writing. If you subscribed before our current plans were introduced, your price and quota stay as we have notified you until we give notice of a change under Section 11.9. The quota belongs to the account owner: members of an account team share it, and messages they upload count toward it.

11.3 What Counts as a Message

A message is each post we read from your connected channels or each pick sheet you upload. Posts with an image count as 3. Bets you type in by hand are always free. Specifically:

• Each message from a connected channel (such as X, Discord, Telegram, SMS, or email) that we process counts as 1 message, or as 3 messages if we process one or more images with it. A message counts as 3 at most, however many images it contains.
• Every message we process from a connected channel counts, whether or not it contains a pick.
• Each pick sheet or screenshot you paste or upload and save counts as 1 message, or 3 if it includes an image, however many bets it contains. Previews that you do not save do not count.
• Bets you enter by hand with the manual entry form never count. Messages we reprocess on our own initiative, automatic retries, and messages we skip without processing do not count. A message is never counted more than once.

11.4 Automatic Overage Charges

When you reach your plan's monthly message allowance, we automatically add 100 more messages to your current billing period for $5.00 (plus any applicable taxes) and immediately charge that amount to your default payment method on file. Each time those 100 messages are used up, the next message adds another 100 messages for $5.00, subject to your overage spending cap (Section 11.5). Each block of 100 messages is charged in full when it is added, whether or not you use all of it, and is not prorated. Unused messages from a block expire at the end of the billing period in which it was added. By subscribing to a paid plan, you authorize these charges. We send a receipt for each charge and email you the first time an overage charge occurs in a billing period. Overage charges do not apply during a free trial, or to accounts whose plan terms we have told you exclude them. If your plan or terms change during a billing period while you are already over the new monthly allowance (for example, when you move to a new plan or when overage charges first apply to your account), we start you at your allowance limit. Messages from before the change are never charged as overage; only messages after it can add a block.

11.5 Overage Spending Cap and Paused Processing

Overage charges are limited by a spending cap of $100.00 per billing period by default. You can raise or lower your cap in your account Settings at any time; the new cap applies to overage charges made after you change it. Setting your cap to $0 means we will never charge you for overage automatically.

If the next overage charge would exceed your cap, if an overage charge fails and a retry also fails, or if you reach the message quota of a free trial, we will keep receiving and storing messages from your connected channels but will pause processing them into tracked bets. We will notify you. Processing resumes once you raise your cap, upgrade your plan, update your payment method, start your paid plan, or a new billing period begins. Held messages are then processed in the order received using their original post times, and count toward your allowance when they are processed. We do not guarantee how quickly held messages are processed after processing resumes.

11.6 Free Trial

We may offer a free trial of the Starter plan to customers who have never had a plan subscription with us, currently 3 days with a trial quota of 50 messages. Each customer may receive only one free trial; if you have had a plan subscription before, including a trial, your paid plan starts immediately. A valid payment method is required to start a trial. Overage charges do not apply during the trial; if you reach the trial quota, processing pauses as described in Section 11.5. Unless you cancel before the trial ends, your subscription automatically converts to the paid Starter plan and your payment method is charged the plan's then-current monthly price, and again each month until you cancel. We will send you a reminder before your first charge. If you start your paid plan or upgrade during the trial, the trial ends and you are charged immediately.

11.7 Automatic Renewal and Cancellation

Paid plans renew automatically each month, and your payment method is charged the plan's monthly price at the start of each billing period until you cancel. You can cancel at any time in your account Settings (Manage billing) or by contacting us at info@sportsdatanow.com. If you cancel a subscription, your access to paid features will continue through the end of the current billing period. Cancellation does not entitle you to a prorated refund for any unused portion of a billing cycle, unused messages, or overage charges.

11.8 Plan Changes and Proration

You can change plans in your account Settings. An upgrade takes effect immediately: you are charged the prorated difference for the rest of the current billing period, and the new plan's quota applies right away. A downgrade takes effect at the start of your next billing period. Overage charges already made in the current billing period are not refunded or credited when you change plans.

11.9 Changes to Prices and Quotas

We may change plan prices, message quotas, the size or price of overage blocks, the default spending cap, or how messages are counted. If a change increases what you pay or reduces what your plan includes, we will email you at least 14 and no more than 30 days before the change first affects a charge to you, stating the change, its effective date, and how to cancel. You may cancel before the change takes effect, and you will not be charged under the new terms. A change never applies to a billing period you have already paid for. Where the law requires your express consent to a change, we will ask for it, and the change will not apply to you until you give it. Otherwise, if you have not cancelled by the effective date after receiving this notice, the change applies from your next charge.

11.10 All Sales Are Final

ALL PURCHASES MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE.

By completing a purchase, you acknowledge and agree that you are not entitled to a refund, credit, or exchange under any circumstances, except at the sole and absolute discretion of Sports Data Now LLC. This includes overage charges, which are non-refundable except where we choose to refund one (for example, because of a billing error).

11.11 Discretionary Refunds

Sports Data Now LLC reserves the right, at its sole discretion, to issue refunds or credits on a case-by-case basis. The issuance of a refund in any one instance does not obligate Sports Data Now LLC to issue a refund in any future instance or to any other user. Refund requests may be submitted to info@sportsdatanow.com and will be reviewed at the discretion of Sports Data Now LLC. We are under no obligation to respond to or honor any refund request.

11.12 Chargebacks

Initiating a chargeback or payment dispute with your bank or card issuer without first contacting Sports Data Now LLC at info@sportsdatanow.com may result in immediate suspension or termination of your account. Sports Data Now LLC reserves the right to contest any chargeback and to pursue recovery of disputed amounts to the fullest extent permitted by law.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. SPORTS DATA NOW LLC DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT DATA WILL BE ACCURATE OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPORTS DATA NOW LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, YOUR RELIANCE ON ANY SERVICE DATA, OR YOUR SHARING OR DISTRIBUTION OF SERVICE-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID BY YOU TO SPORTS DATA NOW LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Sports Data Now LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your infringement of any third-party rights; (d) the accuracy or legality of any data you submit to the Service; or (e) your sharing, distribution, or commercialization of any data or content obtained from the Service.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Pennsylvania. You consent to personal jurisdiction in such courts.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page. Changes to prices, quotas, and overage terms are made only with the advance notice and right to cancel described in Section 11.9, not by updating this page alone. For other changes, your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
